1. Acceptance of Terms

By downloading, installing, or using the Infolio mobile application ("App") or any associated web service ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App or Service.

These Terms constitute a legally binding agreement between you and Infolio ("we," "us," or "our"). By using the App, you confirm that you are at least 13 years of age and have the legal capacity to enter into this agreement.

2. Description of the Service

Infolio is an end-to-end encrypted personal document archive application for iOS and Android. The Service provides:

  • On-device document capture, import, and organization.
  • AI-assisted document structuring using on-device or cloud LLM processing.
  • Encrypted local storage using SQLCipher and full-text search.
  • Optional cloud sync via encrypted blob storage (Cloudflare R2) for registered users.
  • Cross-device synchronization protected by a client-side key hierarchy.
  • Document export and data portability features.

The App may be used in Offline Mode (no account required) or Registered Mode (Apple Sign-In on iOS, Google Sign-In on Android).

3. Accounts & Registration

3.1 Account Creation

Registered accounts are created using Apple Sign-In (iOS) or Google Sign-In (Android). We rely on these providers for identity verification and do not store passwords for OAuth accounts.

3.2 Account Responsibility

You are responsible for maintaining the security of your account. You agree to notify us immediately of any unauthorized use. We are not liable for losses caused by unauthorized account access that results from your failure to secure your credentials.

3.3 One Account Per Device Pairing

Once an account is linked to a device and a Vault Password is set, the local encrypted database is bound to that account's keys. Switching accounts requires deleting all local data. There is no account switching without data loss.

3.4 Account Termination

You may delete your account at any time via Settings → Delete All Local Data. Account deletion permanently removes all server-side data including encrypted blobs, the EMK, and all Space Keys.

4. Vault Password & Encryption

Critical notice: Your Vault Password is the sole means of decrypting your data. We do not have access to your Vault Password, Master Key, or any decrypted content. If you forget your Vault Password and have not set a password hint, your encrypted data cannot be recovered by us or anyone else.

By using Infolio's encrypted vault features, you acknowledge and accept:

  • Your Vault Password is processed exclusively on your device and is never transmitted to our servers.
  • The Encrypted Master Key (EMK) stored on our servers is meaningless without your Vault Password.
  • We cannot reset your Vault Password or recover your encrypted data if you lose access.
  • Setting a password hint is optional but strongly recommended as the sole recovery mechanism.
  • Biometric unlock (Face ID, Touch ID, fingerprint) provides convenient access to the Vault but does not change the underlying dependency on the Vault Password.

5. Acceptable Use

You agree to use Infolio only for lawful purposes and in compliance with all applicable laws. You agree not to:

  • Store, upload, or process any content that is illegal in your jurisdiction, including but not limited to child sexual abuse material (CSAM).
  • Use the Service to store or distribute malware, viruses, or other harmful software.
  • Attempt to reverse-engineer, decompile, or disassemble the App or circumvent its security mechanisms.
  • Use the Service in any manner that could damage, disable, overburden, or impair our infrastructure.
  • Attempt to gain unauthorized access to other users' data or our systems.
  • Use the LLM proxy to process content that violates the terms of service of the underlying LLM provider.
  • Scrape, crawl, or systematically extract data from the Service.

We reserve the right to suspend or terminate accounts that violate these provisions.

6. AI Features & Third-Party APIs

6.1 Platform LLM Quota

Registered users receive a monthly LLM processing quota. Offline Mode users receive a limited lifetime free quota (30 documents per device) tied to App Attest device verification. Quotas are consumed when AI enrichment is requested and cannot be rolled over.

6.2 Bring Your Own Key (BYOK)

You may configure the App to use your own LLM API keys. When using BYOK, your API requests go directly from your device to the LLM provider. We are not responsible for the cost, availability, or terms of third-party LLM providers. You are responsible for complying with the terms of service of any third-party LLM provider you use.

6.3 Ollama (Local LLM)

You may configure the App to use a locally running LLM via Ollama. In this mode, no data is sent to any external service for AI processing. We are not affiliated with or responsible for Ollama or any specific model you choose to run locally.

6.4 AI Output Accuracy

AI-generated content (titles, tags, structured Markdown) is generated automatically and may contain errors, omissions, or inaccuracies. You are responsible for verifying the accuracy of AI-generated content before relying on it for important decisions.

7. Free Quota & Subscriptions

Infolio may offer free tiers and paid subscription plans. The following general terms apply:

  • Free quotas and trial periods are offered at our discretion and may be changed or withdrawn with reasonable notice.
  • Paid subscriptions are billed through the Apple App Store or Google Play Store according to their respective billing terms.
  • All purchases are subject to the refund policies of the respective platform (Apple App Store or Google Play).
  • We reserve the right to change pricing with reasonable advance notice. Price changes will not affect active subscription periods.

8. Your Data & Backups

8.1 Ownership

You retain full ownership of all content you store in Infolio. We claim no ownership rights over your documents.

8.2 Backup Responsibility

Important: While we maintain reliable encrypted cloud storage for registered users, you are solely responsible for maintaining independent backups of your important documents. Use the "Export My Data" feature to download a ZIP archive of all your files.

We are not responsible for data loss resulting from:

  • Forgotten Vault Password (irrecoverable without the correct password).
  • Device loss, theft, or hardware failure where local data has not been synced.
  • Account deletion (voluntary or due to Terms violation).
  • Service disruptions beyond our reasonable control.

8.3 Service Continuity

We will provide at least 90 days' notice before permanently discontinuing the cloud sync service, giving you sufficient time to export your data.

9. Intellectual Property

The Infolio application, including its source code, design, trademarks, and all related intellectual property, is owned by us and is protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for your personal, non-commercial use, subject to these Terms.

You may not copy, modify, distribute, sell, or sublicense any part of the App or Service without our written permission.

10. Disclaimer of Warranties

THE APP AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or completely secure.
  • Any defects will be corrected.
  • AI-generated content will be accurate, complete, or reliable.
  • The Service will meet your specific requirements.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP OR SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $50.

Because Infolio uses end-to-end encryption, we have no ability to access or recover your encrypted data. We expressly disclaim all liability for data loss resulting from lost Vault Passwords or forgotten encryption keys.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with reasonable notice. Grounds for immediate termination include, but are not limited to, violation of the Acceptable Use provisions in Section 5.

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including Sections 9, 10, 11, and 13) will survive.

You may terminate your use of the Service at any time by deleting the App and your account.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law. Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation.

If you are a consumer in the EU, you may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

14. Changes to Terms

We reserve the right to update these Terms at any time. When we make material changes, we will notify you through the app or by updating the "Last updated" date. Your continued use of the App after the effective date of the updated Terms constitutes your acceptance.

If you do not agree to the updated Terms, you must stop using the Service and may delete your account.
